Code Enforcement

The City of Blue Mound’s Code of Ordinance contains rules and regulations for the city and by following these rules and regulations adopted by Blue Mound City Council, citizens help keep the city clean and aesthetically pleasing to those who visit our great City.

Purpose

The purpose of code enforcement is to establish and maintain a standard of quality of life for all citizens by providing quality inspections and bringing about improvements and rehabilitation to the neighborhoods and communities that are served.

Article 12.04 Parking

Section. 12.04.006- Parking on unapproved surfaces

Parking in front, side or back yard.

It shall be unlawful for any person to park or allow to be parked any standard vehicle or special interest vehicle upon the front yard of any residential property. Vehicles may be parked on the side yard or back yard of residential property if such area is: (1) Part of a hard surfaced driveway, pad, or parking area; or (2) Screened from ordinary public view by appropriate means, including a fence, trees or shrubbery.

Article 3.07 Streets and Sidewalks

Section. 3.07.003 Obstructions by trees or shrubs

(a) Trimming required

(1) It shall be unlawful to set out or permit or cause to be set out or maintained any tree, shrub, plant or grass within the parkway area unless it is trimmed as herein provided. (2) All bushes and shrubs within the parkway area more than six (6) inches in diameter at the widest place shall be trimmed to a height of less than four (4) feet above grade. (3) Trees with limbs extending over the parkway must be trimmed so that no limb over the parkway is less than ten (10) feet above ground level. Trees with limbs extending over a street shall be trimmed so that no limb over the street is less than fifteen (15) feet from such street level. (4) If a sidewalk is not adjacent to the curb, from the property side of the sidewalk to the curb, the trimmed requirements will be the same as over the parkway, except no bush or shrub shall extend over the sidewalk. (5) Any property owner with a property line on the edge of city property or state property must keep all trees, shrubs, plants or other objects trimmed to their property line; provided, however, that trees may extend into the parkway area if trimmed in accordance with subsection (3) above, and bushes and shrubs will not exceed four (4) feet in height. (6) “Parkway” as used herein shall be deemed to mean the area between the curb and the nearest property line and shall be presumed to be the five (5) food wide area behind the curb, or, if no curb, five (5) feet parallel to the paved or graveled part of the street.

(b) Duties of property owner.

It shall be the duty of any person, firm, corporation, partnership, association of persons, owner, agent or anyone having supervision or control of any lot, tract, parcel of land, or portion thereof, occupied or unoccupied, within the corporate limits of the city, to remove or cause to be cut and removed all such trees and limbs as often as may be necessary to comply with subsection (a) of this section.

(c) Notice.

In the event of the owner of any lot, tract, parcel of land, or a portion thereof, situated within the corporate limits of the city, shall fail to comply with subsection (b) of this section, then any city office shall notify the owner of the property by personal service, or letter addressed to the owners last known post office address. The city shall have complied with this requirement by advising such owner of their responsibilities under this section.

(d) Failure to comply with notice; penalty.

Any person, firm or corporation who fails to comply with subsection (a) of this section after such 10- day notice shall be deemed guilty of a misdemeanor and, upon conviction, fined in accordance with the general penalty provided in section 1.01.009 of this code. Each day that a violation exists shall constitute a separate offense punishable hereunder.
